End User Agreement

This End User Agreement (“Agreement”) governs your (and your company’s) use of the Kochava attribution fraud analysis report. All references to “you” and “your” refer to the person uploading Your Data (as defined below) and the person or entity that owns Your Data. You hereby grant a limited, non-exclusive, transferable, royalty-free, revocable license to Kochava to receive, process, and use Your Data from for the purpose of providing you with an advertising attribution fraud analysis report (“Report”). “Your Data” means the information provided by you to Kochava via the Mobile Marketing Association (“MMA”) website. Kochava and MMA explicitly disclaim any ownership in Your Data. You reserve all right, title, and interest in Your Data.

  1. You understand and agree as follows:
    1. The Report is merely a representative sample of your likely media exposure to fraudulent advertising activities and is in no way intended to represent a complete analysis;
    2. You will limit your use of the Report to internal purposes only- any other use by you is at your sole risk and expense;
    3. You will not rely upon the Report to inform or influence any decisions which may have legal implications to you, Kochava, or any third party;
    4. Kochava and MMA do not guarantee the accuracy of the Report;
    5. Kochava has the right to share on, an anonymous basis, a summary of the results of the Report with MMA; and
    6. MMA has the right to publish a summary of the results of all Reports, provided that such Report does not disclose your identity.
  1. You represent and warrant that you:
    1. have the legal authority and right to share Your Data with MMA and Kochava;
    2. have received all legally required end-user consents, where applicable;
    3. will not rely on the Report to terminate or reduce current contractual obligations with any third party;
    4. will not publish, reprint, share, or otherwise make available to third parties the Report; and
    5. will indemnify, defend, and hold harmless Kochava and MMA from all related costs, fees, and liabilities if Kochava or MMA becomes subject to any claim related to or arising from your use of the Report your uploading of Your Data.
  1. Kochava warrants that it will:
    1. not, except as set forth herein, disclose your name, Your Data, the Report, or the existence of this agreement to any third party without your advance, written consent;
    2. only use Your Data for the limited purpose of producing the Report;
    3. destroy or delete Your Data within thirty days following delivery of the Report, unless you expressly instruct Kochava otherwise; and
    4. use at least the same degree of care to protect Your Data from unauthorized disclosure as Kochava does to protect its own confidential information.
